Gaming Advertising Requirements from July 1, 2025
The amendments to the Gaming Law, which came into force on July 1, 2025, aim to reduce the availability of gaming and the harm it causes to society.
A transitional period will be in effect until January 1, 2028, during which gaming advertising will be more restricted but still permitted.
Below is a summary of the requirements that took effect on July 1, 2025. For a more detailed consultation, please contact our specialists.
Outdoor Advertising
- It is permitted to display the name and/or trademark of the gaming company on the building of the operator's registered office or the building where gaming activities are organized. Other forms of outdoor advertising are prohibited.
Advertising on Television, Radio, and the Internet
- On television, radio, and the internet, only betting advertising is permitted, and it is subject to content and time restrictions.
- It is permitted to display the name and/or trademark of the betting company, accompanied by the word "betting."
- Betting ads can be broadcast in commercial breaks in clips not exceeding 15 seconds in duration, no more than three times per hour from 6:00 to 18:00, and no more than twice per hour from 18:00 to 24:00.
- A single commercial break may feature betting ads from more than one gaming operator. The time of unused commercial break cannot be carried over to other periods.
Betting Advertising on Websites
- Betting advertising on websites must be static, without any hyperlinks to the betting companies' websites.
- Such advertising cannot exceed 20% of the total advertising space from 6:00 to 18:00 and 10% from 18:00 to 24:00.
- Betting advertising cannot be presented in pop-up windows (i.e., ads that cover all or part of the site's content, or windows that prevent access to the page's content without responding to a query within them, etc.).
- Advertising windows that remain visible while scrolling through the site's content (e.g., sticky banners) are permitted, provided they do not obstruct access to all or part of the site's content.
Other Measures
- It is permitted to display the gaming company's name and/or trademark and information about the types of games at the gaming venue or on the gaming operator's website, the address of which is specified in its gaming regulations.
- It is permitted to publish information about gaming in publications (informational notices) intended exclusively for gaming business entities.
Warning Notice
- As before, all gaming advertising must include a warning notice stating that participation in gaming can lead to gaming addiction or pathological gaming.
Requirements for Trademarks
- Betting advertising may only display the registered, essential elements of a trademark (those which allow the services of one gaming operator to be distinguished from others). Publishing additional written, visual, or audio information is prohibited. For example, displaying "Live Basketball Betting" next to a trademark is not allowed, as this would be considered additional information.
- A betting operator's trademark may only be displayed in the colors and font in which it is registered. It cannot be framed in any geometric shapes, its proportions cannot be changed, and the arrangement of its words and symbols cannot be altered.
Information on Sponsorship
- It is permitted to sponsor (and to provide information about such sponsorship) sports events or their broadcasts, sports organizations, and athletes, as defined in the Law on Sports. Sponsorship of cultural and artistic events or their broadcasts, cultural and artistic organizations, and artists, as defined in the Law on the Status of the Artist and their Organizations and the Law on the Fundamentals of Cultural Policy, is also permitted.
- To prevent abuse, betting operators are not allowed to provide information about the sponsorship of other events or activities that do not meet the definition of cultural or artistic events.
- The sponsor's (the betting operator's) name and/or trademark may be displayed along with information about the event or broadcast, including its time and place. However, it is no longer permitted to display sponsorship information during a live broadcast (as this time would be counted towards the commercial break of gaming advertising).
- It is permitted to display the sponsor's (the betting operator's) name and/or trademark at events, for example, on banners near the sports field or on athletes' jerseys.
The name of a gaming operator cannot be used in the names of sports clubs or leagues. However, the sponsor's name may be indicated next to the sponsored club or athlete, provided it is clearly distinguished. For example: "Basketball Club A, sponsored by Betting Company B."
