LAW AMENDING ARTICLES 10, 206 AND 28

OF GAMING LAW No IX-325

Article 1. Amendment to Article 10

1. To supplement Article 10 with paragraph 20:

“20. Each person shall have the right to submit the application to prohibit him from participating in gaming and from taking part in remote gaming (hereinafter – the application for prohibition against gaming) to the Control Authority or gaming operator. The application for prohibition against gaming may specify a period selected by a person during which he is prohibited from gaming, which may not be shorter than 6 months. A person may withdraw the submitted application for prohibition against gaming or shorten the period specified in the application, however no earlier than after 6 months following the submission of the application for prohibition against gaming. The procedure for submission of the applications for prohibition against gaming to the Control Authority or gaming operator shall be established by the Control Authority.”

2. To supplement Article 10 with paragraph 21:

“21. It shall be prohibited to let the persons, who submitted the application for prohibition against gaming, enter the gaming establishments and to allow them to participate in remote gaming during the period specified in their applications for prohibition against gaming, and, if the application for prohibition against gaming does not specify the period, – 2 years from the date of submission of the application for prohibition against gaming to the Control Authority or gaming operator. It shall be also prohibited to let the persons, who have been acknowledged incapacitated or having limited capacities in this field by court procedure according to Section III of Chapter I of Part I of the Book Two of the Civil Code of the Republic of Lithuania, enter the gaming establishments and to allow such persons to participate in remote gaming. The fulfilment of such requirements must be ensured by the gaming operator.”

Article 2. Amendment to Article 206

To repeal item 4 of paragraph 1 of Article 206.

Article 3. Amendment to Article 28

To supplement Article 28 with item 8:

“8) process the data of persons, who submitted the applications for prohibition against gaming, also sensitive data (about persons’ incapacity or limited capacity in this field).“

Article 4. Entry into Force of the Law and Its Implementation

1. This Law, except for paragraph 2 of this Article, shall enter into force on 1 May 2017.

2. The Government of the Republic of Lithuania or its authorised institution shall adopt legal acts implementing this Law by 30 April 2017.
